Definitions:

Mediation – in mediation, a professionally trained mediator helps the parties to work out their own mutually agreeable solution to the dispute

Arbitration – method of alternative dispute resolution where neutral party or parties helps make decision and decision is binding.

Alternative dispute resolution - Also known as "ADR"; methods by which legal conflicts and disputes are resolved privately and other than through litigation in the public courts, usually through one of two forms: mediation or arbitration. It typically involves a process much less formal than the traditional court process and includes the appointment of a third-party to preside over a hearing between the parties. The advantages of ADR are speed and money: it costs less and is quicker than court litigation. ADR forums are also private. The disadvantage is that it often involves compromise.

Arbitration clause - a clause in a contract providing for arbitration of disputes arising under the contract

Arbitration agreement - a written contract in which two or more parties agree to use arbitration, instead of the courts, to decide certain disputes. The arbitration agreement is ordinarily a clause in a larger contract. The disputes may be about the performance of a specific contract, a claim of unfair or illegal treatment in the workplace, a faulty product, or just about anything else. People are free to agree to arbitrate just about anything they could litigate.
