The Safest Place to Store Your Data: Your Hard Drive, or “The Cloud”? CBC News, March 18, 2009: Hackers, identity thieves, viruses, hard drive crashes, law enforcement agents, fires, floods, and a host of other dangers can all do nasty things to your files, so where is the safest place to keep them? Keeping sensitive files in a server on the internet – sometimes termed “in the cloud” – has the advantages of portability and the large security apparatus of a company such as Google. If your hard drive is lost, stolen, or damaged, files remain safe in the cloud. However, hard drive storage puts you in control of your own data and keeps it out of the hands of unknown cloud data and security managers. Experts say when choosing where to keep your files, consider which risks you are more comfortable taking and the level of sensitivity of the data. Link to full story A Bill to Shift Cybersecurity to White House Cnet.com, March 20, 2009: A bill authored by Senators Jan Rockefeller (D-W.V.) and Olympia Snowe (R-Maine) would take responsibility for cybersecurity from the U.S. Department of Homeland Security and give it to the White House. The bill would create an Office of the National Cybersecurity Advisor and a Cybersecurity Advisory Panel to advise the President and address national and international cybersecurity issues. Industry groups are expected to oppose a provision of the bill that would give the National Cybersecurity Advisor the power to disconnect “critical” federal networks from the Internet in the event of a cyberattack. Link to full story Economic Stimulus Plan Spurs Spam Cnet.com, March 4, 2009: Since President Obama’s economic stimulus plan was launched, the Federal Trade Commission has reported a large uptick in spam related to the stimulus plan. According to the FTC, “[d]eceptive Web sites, advertisements, and e-mail campaigns have cropped up across the Web in recent weeks, luring consumers into scams by promising them federal grant money from the stimulus package.” Both Google and Facebook have joined with the FTC to pull fraudulent advertisements related to the stimulus plan. Many of the advertisements use President Obama’s photo and offer funds through the stimulus plan. The FTC believes that these fraudulent advertisements and spam usually lead consumers to giving out sensitive information, which is then used by the recipient for identity theft. Link to Full Story Web Inventor Warns about Internet Snooping Guardian.co.uk, March 11, 2009: Sir Tim Berners-Lee, the inventor of the worldwide web, warned that third parties, including commercial companies shouldn’t be allowed to view consumers’ Internet browsing. Knowing what a consumer is browsing through can be very helpful to a third-party because it shows exactly what the consumer is looking for at that moment in time. This sensitive information can be very powerful to companies looking to sell goods or services. Sir Tim Berners-Lee believes that Internet users browse the worldwide web in a particular fashion right now and their Internet activities would change greatly if they knew a third-party was watching their every move. He maintains that third-party possession of this information about Internet usage could contribute to activities detrimental to the interests of Internet users, like selling confidential personal information, affecting job application considerations, and determining insurance premiums. Link to Full Story Deb Shops, Inc. v. M S Complainant, Deb Shops, Inc. and D.B. Royalty, Inc., brought a UDRP claim against Respondent for the <debs.com>, <debs.ws>,<debs.biz>, and <debs.mobi> domain names. Complainant registered its DEB mark (Reg. No. 1,003,568 issued January 28, 1975) with the United States Patent and Trademark Office (“USPTO”). Respondent argued that the disputed domain names contained generic terms. Complainant maintained that Respondent was using the disputed domain names to direct Internet users to competing commercial websites. The Panel found Respondent’s use of the disputed domain names did not establish rights or legitimate interests in the disputed domain names under Policy ¶ 4(a)(ii) and was evidence of bad faith registration and use under Policy ¶¶ 4(b)(iii) and (iv). Therefore the Panel transferred the disputed domain names to Complainant. Deb Shops, Inc. v. M S, FA 1239510 (Nat. Arb. Forum Feb. 17 2009). Peaches Uniforms Inc. v. 24-7 Outdoors Inc. Complainant, Peaches Uniforms Inc., brought a UDRP claim against Respondent for the <peaches.com> domain name. Complainant had rights in its PEACHES mark dating back to June 6, 2006 as a result of its United States Patent and Trademark Office (“USPTO”) registration (Reg. Nos. 3,223,701 and 3,223,702 issued April 3, 2007). Complainant also claimed common law rights in the PEACHES mark; however, the Panel found that its exhibits did not support a finding of common law rights. Respondent registered the disputed domain name in 1995. The Panel found that because “peaches” is a descriptive or generic term, and Respondent did not appear to be targeting Complainant upon registration, that Respondent had not acted in bad faith under Policy ¶ 4(a)(iii). Therefore, the Panel declined to transfer the disputed domain name. Peaches Uniforms, Inc. v. 24-7 Outdoors Inc., FA 1238992 (Nat. Arb. Forum Feb. 9, 2009). NetApp, Inc. v. Linett Complainant, NetApp, Inc., brought a UDRP claim against Respondent for the <netapp.org> domain name. Respondent asserted that the term “netapp” is an established acronym for “network application.” The Panel, however, found that Respondent’s evidence – an extract from the Free Dictionary Online that associates the acronym with Complainant’s name – was not sufficient to establish the term is commonly used. Therefore, the Panel found that Complainant had satisfied the requirements under the Policy and transferred the disputed domain name. NetApp, Inc. c. Linett, FA 1238829 (Nat. Arb. Forum Feb. 5, 2009). L.F.P., Inc. v. Domain Contact Complainant brought a UDRP claim against Respondent for the <barelylegalteens.com> domain name. The Panel found that Complainant had rights in its BARELY LEGAL mark, through its United States Patent and Trademark Office (“USPTO”) registration. Respondent alleged the disputed domain name is comprised of common, generic terms. The Panel found that the Respondent was using the disputed domain name to compete with Complainant’s services, and consequently found Respondent had no rights or legitimate interests under Policy ¶ 4(a)(ii) and had acted in bad faith under Policy ¶ 4(a)(iii). Therefore, the Panel transferred the disputed domain name. L.F.P., Inc. v. Domain Contact, FA 1238666 (Nat. Arb. Forum Feb. 6, 2009). Disney Enterprises, Inc. v. HB Concepts LLC Complainant, Disney Enterprises, Inc., brought a UDRP claim against Respondent for the <disneyworld-rental-home.com> domain name. The Panel found that Complainant had established rights in its DISNEY mark and that the disputed domain name was confusingly similar to the mark pursuant to Policy ¶ 4(a)(i). Respondent contended “disneyworld” had taken on a generic meaning as a location, which referred to where Respondent’s rental property was located. The Panel, however, found that Respondent did not provide evidence to support those contentions and found that Policy ¶ 4(a)(ii) and Policy ¶ 4(a)(iii) had been met. Therefore, the Panel transferred the disputed domain name to Complainant. Disney Enters., Inc. v. HB Concepts LLC, FA 1241904 (Nat. Arb. Forum Feb. 16, 2009). Caris Ltd. v. Texas International Property Associates - NA NA Complainant, Caris Ltd, brought a UDRP claim against Respondent for the <carishealth.com> domain name. Complainant applied for registration of its CARIS mark with the United States Patent and Trademark Office (“USPTO”) on August 3, 2006. Complainant also claimed a March 1, 2005, date of first use in commerce; however, the Panel found that Complainant did not allege or prove common law rights in the mark prior to Respondent’s registration of the mark with the USPTO on June 5, 2006. The Panel found Complainant had failed to establish bad faith registration and use pursuant to Policy ¶ 4(b)(iii), and therefore, the Panel declined to transfer the disputed domain name to Complainant.Caris Ltd. v. Texas Int’l Prop. Assocs., FA 1234694 (Nat. Arb. Forum Jan. 6, 2009). Ashley Furniture Industries, Inc. v. Zournas Complainant, Ashley Furniture Industries Inc., brought a UDRP claim against Respondent for the <ashley.biz> domain name. The Panel found Complainant had rights in its ASHLEY mark, which was identical to Respondent’s <ashley.biz> domain name under Policy ¶ 4(a)(i). Respondent alleged that “Ashley” is a common and generic term or name. The Panel found, however, that Respondent did not have rights or legitimate interests in the disputed domain name under Policy ¶ 4(a)(ii) because Respondent was not commonly known by the disputed domain name, and because of Respondent’s competing use. The Panel also found that Respondent had registered and used the disputed domain name in bad faith under Policy ¶ 4(a)(iii). Respondent had also raised the issues of doctrine of laches and reverse domain name hijacking, but the Panel found that the doctrine of laches was not applicable under the Policy and that since Complainant had satisfied Policy ¶ 4(a)(i), there was no reverse domain name hijacking. Therefore, the Panel transferred the disputed domain name.Ashley Furniture Indus. Inc. v. Zournas, FA 1235340 (Nat. Arb. Forum Jan. 20, 2009). Radisson Hotels International, Inc. v. Gleb Complainant, Radisson Hotels International, brought a UDRP claim against Respondent for the <radissonescort.com> domain name. The Panel found Complainant had established rights in its RADISSON mark, and that the disputed domain name was confusingly similar to the mark pursuant to Policy ¶ 4(a)(i). Respondent contended her real name was “Olga Radisson,” and that she provides escort-dating services. Nevertheless, the Panel found that Respondent had not met the burden of demonstrating rights or legitimate interests in the disputed domain name under Policy ¶ 4(a)(ii). The Panel also concluded Respondent had engaged in bad faith registration and use under Policy ¶ 4(a)(iii). Therefore, the Panel transferred the disputed domain name to Complainant.Radisson Hotels Int’l Inc. v. Gleb, FA 1233302 (Nat. Arb. Forum Dec. 30, 2008). Toyota Motor Sales U.S.A. Inc. v. The Car Openers Inc. Complainant, Toyota Motor Sales U.S.A. Inc., brought a UDRP claim against Respondent for the <lexuskeys.com> domain name. The Panel found Complainant had established sufficient rights in its LEXUS mark, and that the mark and domain name were confusingly similar pursuant to Policy ¶ 4(a)(i). Respondent asserted it used the disputed domain name to sell “genuine and unlicensed keys” to vehicles sold under Complainant’s LEXUS mark, and that it utilized numerous disclaimers on the website to prevent consumer confusion. Nevertheless, the Panel found Respondent’s use of the disputed domain name was evidence that Respondent was not using the disputed domain name in accordance with Policy ¶ 4(a)(ii). Additionally, the Panel found Respondent’s actions evidenced bad faith registration and use pursuant to Policy ¶ 4(a)(iii). Thus, the Panel found Complainant had satisfied the requirements under the Policy, and transferred the disputed domain name. Toyota Motor Sales U.S.A. v. The Car Openers Inc., FA 1233077 (Nat. Arb. Forum Dec. 31, 2008). Misikko, Inc. v. Freedman Complainant, Misikko, Inc., brought a UDRP claim against Respondent, Iko Freedman, for the <missiko.com> domain name. Complainant contended it had common law rights in its MISIKKO.COM mark. The Panel found “common law right demonstration requires an evidentiary submission providing, inter alia, indications in respect of length and amount of sales under the mark, nature and extent of advertising, consumer survey and media recognition.” The Panel found that Complainant had not submitted evidence to that effect, and thus had failed to establish common law rights in the MISIKKO.COM mark pursuant to Policy ¶ 4(a)(i). Consequently, the Panel declined to transfer the disputed domain name. Misikko, Inc. v. Freedman, FA 1235081 (Nat. Arb. Forum Jan. 2, 2009). Citigroup Inc. v. Citilend Mortgage Co. Complainant, Citigroup Inc., brought this UDRP claim against Respondent for the <citilend.com> domain name. The disputed domain named resolved to a website providing links to Complainant’s direct competitors. Respondent did not specifically deny any of Complainant’s allegations regarding confusing similarity or rights and legitimate interests. The Panel accordingly found that Complainant had established Policy ¶¶ 4(a)(i) and (ii). Respondent did alleged that it was not aware of Complainant’s rights in the CITI mark at the time it started its business in 1998. The Panel nevertheless found bad faith registration and use of the domain name because Complainant need not prove Respondent’s actual knowledge of its mark. Consequently, the Panel found bad faith under Policy ¶ 4(a)(iii) and ordered the transfer of the <citilend.com> domain name to Complainant. Citigroup Inc. v. Citilend Mortgage Co., FA 1233601 (Nat. Arb. Forum Dec. 1, 2008). Enterprise Rent-A-Car Co. v. Enterprise Group c/oKadomtsev Complainant, Enterprise Rent-A-Car Co., brought a UDRP claim against Respondent for the <enterpriseholding.com> domain name. Complainant argued Respondent was using a confusingly similar domain name to operate a website with links to Complainant’s competitors. Respondent argued that the term “enterprise” is a common word, and that Respondent operates in consulting and exporting food ingredients, which is not similar to Complainant’s car rental business. Respondent also maintains that it has registered a portfolio of domain names containing the term “enterprise” to use in conjunction with its business and none of these domain names contain terms related to car rental services. Respondent further contends the website resolving from the disputed domain name was operated by the registrar, and that after notice from Respondent, the registrar complied with Respondent’s request to take down the content. The Panel found Respondent’s disputed domain name was not confusingly similar to Complainant’s mark and that Respondent did not register and use the disputed domain name in bad faith. Thus the Panel denied Complainant its requested relief. Enterprise Rent-A-Car Co. v. Enterprise Group, FA 1229429 (Nat. Arb. Forum Dec. 9, 2008). SPTC, Inc. & SPTC Delaware, LLC c/o Sotheby's Holdings, Inc. v. The Allgood Co. Complainant brought a UDRP claim for the <sothebyshome.com> domain name. Complainant contended that the disputed domain name resolved to a links page displaying various advertisements and links to third-party competitors. Respondent asserted that it had made no use of the <sothebyshome.com> domain name, had provided no plans to do so, had not authorized anyone to use the disputed domain name, and was not aware of who had posted content to the resolving website. However, the Panel declined to accept Respondent’s arguments, reasoning that Respondent remained responsible for whatever use was made of the <sothebyshome.com> domain name. Moreover, even if Respondent truly had failed to make any active use of the disputed domain name, the Panel reasoned that this still only proved that Respondent lacked rights and legitimate interests under Policy ¶ 4(a)(ii). Having also found Policy ¶¶ 4(a)(i) and (iii) satisfied, the Panel ordered the transfer of the <sothebyshome.com> domain name to Complainant. SPTC, Inc. & SPTC Del., LLC c/o Sotheby's Holdings, Inc. v. Allgood Co., FA 1 231251 (Nat. Arb. Forum Nov. 11, 2008). State Farm Mutual Automobile Insurance Co. v. Real Estate c/o Tuggle Complainant, State Farm Mutual Automobile Insurance Co., brought a UDRP claim against Respondent for the <loritugglestatefarm.com> and <loritugglestatefarm.info> domain names. Complainant is an insurance company and Respondent is the ex-husband of “Lori Tuggle,” one of Complainant’s agents. Respondent asserted he was not aware of Complainant’s trademark rights when he registered the disputed domain names, and that he had intended to give the disputed domain names as a gift to his ex-wife. Respondent also stated that he approved the remedy requested by Complainant. The Panel, however, found that Respondent did not consent to a unilateral transfer of the disputed domain names because he submitted a Response disputing Complainant’s arguments and denying that he registered or was using the disputed domain names in bad faith. The Panel proceeded to analyze the parties’ arguments under Policy ¶ 4(a), found Complainant had satisfied the elements of the Policy, and transferred the disputed domain names to Complainant. State Farm Mut. Auto. Ins. Co. v. Real Estate, FA 1230602 (Nat. Arb. Forum Dec. 8, 2008). Motorola, Inc. & Symbol Technologies, Inc. v. Giovinazzo Complainants, Motorola, Inc. and Symbol Technologies, Inc., brought a UDRP Complaint against Respondent regarding the <symboleuropa.com> domain name. Complainant claimed rights in the SYMBOL mark based on its registrations throughout the world. Respondent contended that it was operating a restoration construction business under the Symbol Reformas name in Spain. No current active use of the disputed domain name was being made. The Panel determined that the disputed domain name was confusingly similar to Complainant’s mark pursuant to Policy ¶ 4(a)(i). The Panel also found that Respondent’s failure to make any active use of the <symboleuropa.com> domain name for the better part of a year since registration evidenced a lack of rights or legitimate interests under Policy ¶ 4(a)(ii) and that Respondent registered and was using the disputed domain name in bad faith pursuant to Policy ¶ 4(a)(iii). Accordingly, the Panel ordered the transfer of the <symboleuropa.com> domain name to Complainant. Motorola, Inc. v. Giovinazzo, FA 1 231037 (Nat. Arb. Forum Oct. 31, 2008). American Automobile Association, Inc. v. Zag Media Corp. Respondent, identified as “Zag Media Corp. c/o Whois Privacy Service,” contended that it was only managing the <aaacars.com> domain name for its customer, which Respondent referred to as “the domain owner.” After reading ICANN Rule 1 in conjunction with the FORUM’s Supplemental Rule 1(d), the Panel determined that the proper Respondent was only the individual or entity listed in the WHOIS information for the disputed domain name. Without Respondent providing any further information as to the identity of the supposed actual “domain owner,” the Panel concluded that since Respondent essentially acted solely as a proxy registration service, Respondent lacked rights and legitimate interests in the disputed domain name under Policy ¶ 4(a)(ii). The Panel then found that Respondent’s concealment of the supposed “domain owner,” combined with other holdings to supported a finding of bad faith pursuant to Policy ¶ 4(a)(iii). As a consequence, the Panel ordered the transfer of the <aaacars.com> domain name to Complainant. Am. Auto. Assoc., Inc. v. Zag Media Corp., FA 1226952 (Nat. Arb. Forum Nov. 13, 2008). Etsy, Inc. v. Texas International Property Associates Complainant, Etsy, Inc., brought this UDRP claim for the <etsey.com> domain name. Respondent contended that the Complainant’s Additional Submission was improper under ICANN Rule 12 because the Panel did not solicit it. This submission was accepted under FORUM ’s Supplemental Rule 7, which Respondent argued is invalid because it conflicts with the ICANN rules. The Panel disagreed and found Complainant’s filing of an Additional Submission to be proper under both ICANN Rule 12 and Supplemental Rule 7. However, the Panel determined that Respondent could not have registered the disputed domain name in bad faith pursuant to Policy ¶ 4(a)(iii) because Complainant had not established either registered or common law trademark rights and was not otherwise well known before the registration of the mark. Having failed to establish this element, the Panel declined to transfer the <etsey.com> domain name. Etsy, Inc. v. Texas Int’l Prop. Assocs., FA 1222645 (Nat. Arb. Forum Nov. 11, 2008). Harrah's License Company, LLC v. Hawkins Complainant, Harrah’s License Company, brought a UDRP Complaint against Respondent in regards to the <horseshoeindiana.com> domain name. Complainant claimed rights in the HORSESHOE mark evidencing registration with the United States Patent and Trademark Office.The Panel determined that the disputed domain name was confusingly similar to Complainant’s mark pursuant to Policy ¶ 4(a)(i). The Panel also found that Respondent failed to meet its burden of demonstrating rights and legitimate interests in the disputed domain name pursuant to Policy ¶ 4(a)(ii) because the disputed domain name was listed for sale through its website. Upon these same grounds, the Panel found bad faith under Policy ¶ 4(a)(iii). Accordingly, the Panel ordered the transfer the <horseshoeindiana.com> domain name to Complainant. Harrah's License Co., LLC v. Hawkins, FA 1225284 (Nat. Arb. Forum Oct. 31, 2008). Skyy Spirits LLC v. Krzenszsczynski Complainant, Skyy Spirits LLC, filed a UDRP Complainant against Respondent for the transfer of the <skyyvodkas.com> domain name. Respondent did not reply to the Complaint. The Panel found that Complainant had established rights in the SKYY VODKAS mark and that the disputed domain name was not adequately distinguishable from this mark under Policy ¶ 4(a)(i). However, the Panel determined that Complainant failed to establish either Policy ¶¶ 4(a)(ii) or (iii) because Complainant failed to provide any evidence of Respondent’s use to the Panel. The Panel held that a prima facie case cannot be based on allegations alone, but that supporting evidence must accompany a complaint. Based upon these evidentiary deficiencies, the Panel denied the requested relief without prejudice to refile the Complaint. Skyy Spirits LLC v. Krzenszsczynski, FA1220829 (Nat. Arb. Forum Nov. 26, 2008). Cotterweb Enterprises Inc. v. Texas International Property Associates – NA NA Complainant, Cotterweb Enterprises Inc., brought a UDRP claim against Respondent, Texas International Property Associates – NA NA, for the <iboxdollars.com> domain name. The Panel found Complainant had established rights in its INBOXDOLLARS mark pursuant to Policy ¶ 4(a)(i). Complainant contended that Respondent was using the disputed domain name to display links to Complainant’s competitors. Respondent stated that it was contracting with third-parties to provide the links and advertisements on the website, and therefore did not control the use of the website. The Panel found that Respondent remained responsible for the content posted to its websites and therefore was in violation of Policy ¶ 4(a)(ii). Additionally, the Panel found that Respondent engaged in bad faith registration and use under Policy ¶ 4(b)(iii), because it admitted to commercially profiting from its competing use of the disputed domain name and had previous UDRP decisions decided against it. Therefore, having established all three elements of the Policy, the Panel transferred the disputed domain name to Complainant. Cotterweb Enterps. v. Texas Int’l Prop. Assocs., FA 1227142 (Nat. Arb.
